Background<\/strong><\/h2>\n\n\n\n

“On December 13, 2023, the Commission adopted the Second Text Blocking Report and Order in
the above-captioned proceedings. In this rule making, the Commission adopted a new rule that makes it
unequivocally clear that prior express written consent under the Telephone Consumer Protection Act must be to one seller at a time<\/strong>.” From FCC Public Notice<\/a><\/p>\n<\/blockquote>\n\n\n\n

“(9)<\/strong>\u00a0The term\u00a0prior express written consent<\/em><\/strong>\u00a0means an agreement, in writing, bearing the signature of the person called that clearly authorizes the seller to deliver or cause to be delivered to the person called advertisements or telemarketing messages using an automatic telephone dialing system or an artificial or prerecorded voice, and the telephone number to which the signatory authorizes such advertisements or telemarketing messages to be delivered.<\/p>\n\n\n\n

(i)<\/strong> The written agreement shall include a clear and conspicuous disclosure informing the person signing that:<\/p>\n\n\n\n

(A)<\/strong> By executing the agreement, such person authorizes the seller to deliver or cause to be delivered to the signatory telemarketing calls using an automatic telephone dialing system or an artificial or prerecorded voice; and<\/p>\n\n\n\n

(B)<\/strong> The person is not required to sign the agreement (directly or indirectly), or agree to enter into such an agreement as a condition of purchasing any property, goods, or services.<\/p>\n\n\n\n

(ii)<\/strong>\u00a0The term \u201csignature\u201d shall include an electronic or digital form of signature, to the extent that such form of signature is recognized as a valid signature under applicable federal law or\u00a0state<\/a>\u00a0contract law.” From LII<\/a> scroll to (f)(9).<\/p>\n<\/blockquote>\n\n\n\n
